These Terms & Conditions apply to orders placed by consumers through our online shop at the-source-lab.com.

A consumer is any natural person entering into a legal transaction for purposes that are predominantly outside that person's trade, business or independent professional activity.

The contracting party and seller is:

Our online shop is primarily intended for consumers. Orders that are clearly placed predominantly for commercial, self-employed or professional purposes, or for commercial resale, may be rejected.

Separate contractual terms may apply to business customers.

The presentation of products in our online shop does not generally constitute a legally binding offer to conclude a purchase contract. It is an invitation to submit an order.

You may first place products in your shopping cart. Before submitting your order, you can review the information entered and the contents of your cart and correct them using the functions provided during the ordering process.

Before you complete the order, you will in particular be shown the selected products, the total price, any applicable shipping costs and the available payment methods.

By activating the final order button, you submit a binding offer to conclude a contract for the products contained in your shopping cart.

The button used to place an order involving an obligation to pay clearly indicates, in accordance with the applicable legal requirements, that placing the order creates a payment obligation.

After we receive your order, you will receive an electronic confirmation acknowledging receipt. Unless that confirmation expressly states that your offer has been accepted, the automated acknowledgement itself does not constitute acceptance.

For physical goods, the purchase contract is concluded when we accept your offer by sending an express order confirmation, a shipping confirmation or by dispatching the goods. The earliest of these events is decisive.

In the case of a voucher supplied exclusively in digital form, acceptance may instead take place by express contract confirmation or by electronically providing the voucher or voucher code.

A technical reservation, authorisation or preliminary charge to a payment method does not by itself constitute acceptance of the order.

If an order is not accepted and an amount has already been collected, the amount will be refunded without undue delay or an existing payment reservation will be released.

We are not obliged to accept an offer. This applies in particular to unavailable products, obviously incorrect price or product information, reasonable suspicion of misuse or an order clearly intended for commercial resale.

The individual technical steps for concluding a contract follow the ordering process:

• selection of the product
• adding the product to the shopping cart
• opening the shopping cart or checkout
• entering or selecting the required customer, delivery and payment information
• reviewing the order summary
• correcting entries where necessary
• binding submission of the order involving an obligation to pay

Before submitting your order, you can identify and correct input errors using the editing and correction functions provided in the shopping cart and checkout.

The contract text and order data are stored by us for the statutory and operational retention periods applicable to us.

After conclusion of the contract, you will receive the contractual information relevant to your order on a durable medium, in particular by email, within the legally required period.

The applicable Terms & Conditions, withdrawal information and additional contractual information can also be accessed through our website and saved or printed.

If you use a customer account, additional information about your orders may be available there.

Our shop may be offered in several language versions. Contract languages are German, English and Dutch where the respective language is offered in the ordering process for the relevant market.

The language version of the contractual information used during the relevant ordering process applies to that order.

The use of English as a contract language does not in itself change the law applicable to the contract.

We have not submitted to any specific code of conduct unless expressly stated otherwise in the relevant offer.

All prices displayed to consumers in our online shop are total prices in euros and include the VAT legally applicable to the respective transaction where VAT is due.

Shipping charges may apply in addition. The shipping costs applicable to your delivery country and order are shown before you submit the order.

The payment methods available for your order are displayed during checkout. There is no entitlement to a particular payment method.

Unless otherwise stated for a particular payment method, the purchase price becomes due upon conclusion of the purchase contract.

When external payment services are used, the terms of the respective payment service provider may additionally apply. Your statutory rights against us as seller remain unaffected.

Additional conditions stated for the respective promotion or offer may apply to discount codes, vouchers, bundles, quantity discounts and time-limited promotions.

Unless otherwise stated for the relevant promotion, a discount code cannot generally be applied retrospectively to an order that has already been completed.

We deliver to the countries and regions that can be selected as the delivery country during the ordering process.

Any delivery restrictions and the delivery methods available for the relevant order are displayed in the shop and no later than at the beginning of or during the ordering process.

Storage, picking, packing and operational shipping may be handled by our fulfilment partner HIVE.

Mittelweser Heilquellen GmbH remains your contracting party and seller.

Shipping rates and any free-shipping thresholds vary by delivery market. The conditions applicable to your delivery country are published in our Shipping Information and are shown before the order is completed.

The shipping costs applicable to your individual order are displayed before you place the order.

The estimated delivery time is shown on the relevant product page or during the ordering process.

We may dispatch an order in several partial deliveries where this is reasonable for you. If partial deliveries are made solely for reasons relating to our shipping organisation, we will not charge additional shipping costs for them.

In consumer contracts, the risk of accidental loss of or accidental damage to the goods generally passes only when the goods are delivered to you or to a recipient designated by you, subject to the applicable statutory rules.

Please ensure that the delivery address provided is complete and correct.

If a shipment cannot be delivered for a reason attributable to you and you request renewed shipment, the additional shipping costs actually incurred as a result may be charged to you.

Your statutory rights remain unaffected.

Where we offer digital SOURCE LAB value vouchers, the information on the respective product page also applies.

The voucher is supplied electronically in the form described there and can be redeemed for products in our online shop in accordance with the conditions stated for that voucher.

Statutory consumer rights also apply when purchasing a voucher. Any specific mandatory rules applicable to the particular form of supply or redemption remain unaffected.

A voucher value will only be paid out in cash where this is required by law or expressly agreed.

The goods delivered remain the property of Mittelweser Heilquellen GmbH until the purchase price has been paid in full, to the extent permitted by applicable law.

Consumers have a statutory right of withdrawal where the applicable legal requirements are met.

Full information about the conditions, withdrawal period, exercise of the right, consequences of withdrawal, return costs and the model withdrawal form can be found in our separate Withdrawal Policy.

During the statutory withdrawal period, we also provide the electronic withdrawal function required for eligible distance contracts concluded through an online interface.

This allows you to submit your withdrawal directly online. Use of this function is an additional simple method and does not exclude any other legally permitted way of exercising your right of withdrawal.

In the event of a statutory withdrawal, you bear the direct cost of returning the goods where we have properly informed you of this and have not expressly agreed to bear those costs ourselves.

You are welcome to contact our customer service before returning goods so that we can provide the return information intended for your order.

Prior contact with us and the use of a particular return label are not conditions for the valid exercise of your statutory right of withdrawal.

In addition to your statutory rights, we offer a voluntary 30-day satisfaction guarantee for eligible care products purchased directly through the-source-lab.com.

The full guarantee conditions published on our Right of Withdrawal page apply.

These conditions include information on the guarantor, eligible products, duration and geographical scope, the procedure for making a claim, return conditions and reimbursement.

The satisfaction guarantee does not apply to products purchased from other sellers or platforms unless the guarantee conditions expressly state otherwise.

The statutory rights applicable to defective or non-conforming goods apply to the products sold by us.

If goods delivered are defective, damaged or do not correspond to the order, you are entitled to the remedies provided by the applicable mandatory law.

Subject to the applicable statutory requirements, this may include in particular repair, replacement and, where the relevant requirements are met, a price reduction or termination of the contract.

Costs that we are legally required to bear in connection with a statutory remedy are borne by us in accordance with the applicable law.

Where possible, please provide your order number and identify the product concerned.

Photographs may make it easier to assess and process a complaint, but they are not a condition for exercising your statutory consumer rights.

Voluntary guarantees and goodwill services do not restrict statutory conformity or defect rights.

We have unlimited liability:

• in cases of intent and gross negligence,
• for damage resulting from injury to life, body or health,
• under applicable product-liability law,
• in the event of fraudulent concealment of a defect,
• where an express guarantee has been given, unless the guarantee itself provides otherwise.

In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical for the contract at the time it was concluded, to the extent permitted by applicable law.

Essential contractual obligations are obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may normally rely.

In all other respects, liability for damage caused by slight negligence is excluded to the extent legally permissible.

The above liability provisions apply correspondingly for the benefit of our legal representatives, employees and agents.

Any mandatory consumer-protection or liability rules applicable to you remain unaffected.

Mittelweser Heilquellen GmbH is currently neither obliged nor willing to participate in dispute resolution proceedings before a German consumer conciliation body, unless a mandatory legal obligation applies in an individual case.

The former European Online Dispute Resolution platform has been discontinued and is therefore no longer included in this consumer information.

Your statutory right to seek judicial remedies or to use any mandatory consumer redress mechanisms available to you remains unaffected.

The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer whose habitual residence is in another country, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of that country which cannot be derogated from by agreement.

This applies in particular to consumers resident in another EU Member State where the statutory requirements for the application of the mandatory consumer-protection rules of that state are met.

The fact that these Terms & Conditions are made available in English or another language does not itself alter the applicable law.

The statutory rules on jurisdiction applicable to consumers remain unaffected.

The version of these Terms & Conditions incorporated into the relevant contract at the time the order is concluded applies to that order.

If one or more provisions of these Terms & Conditions are or become wholly or partly invalid or unenforceable, the validity of the remaining provisions is unaffected.

The applicable statutory provisions apply in place of an invalid provision.
