§ 1 Scope and Contracting Party
These General Terms and Conditions apply to all orders placed by consumers via the online shop at the-source-lab.com.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed.

The online shop is exclusively for consumers. Orders for commercial, self-employed or professional purposes will not be processed via the online shop.

§ 2 Offer and Conclusion of Contract
The presentation of our products in the online shop does not constitute a legally binding offer to conclude a purchase contract, but an non-binding invitation to place an order.
You can initially place the desired products in the shopping cart and check and correct your information at any time during the ordering process.
By clicking the final order button, you submit a binding offer to purchase the products contained in the shopping cart.
After receipt of your order, you will receive an automatic email confirming receipt of the order. This confirmation of receipt does not yet constitute acceptance of your offer, unless explicitly stated otherwise in the message.
The purchase contract is concluded as soon as we accept your order by an express order confirmation, a shipping confirmation or by sending the goods. The earliest point in time is decisive.
A reservation, authorization or provisional debit of a payment method does not alone constitute acceptance of the order. If an order is not accepted, any amounts already collected will be refunded immediately or reserved amounts will be released.
We are not obliged to accept an order. This applies in particular to unavailable products, clearly incorrect price information, justified suspicion of misuse or an order that is clearly placed for commercial resale purposes.
§ 3 Ordering Process, Contract Language and Storage
Before submitting your order, you can correct any input errors using the correction options provided in the ordering process.
The contract language relevant for the conclusion of the contract is German.
We store your order data within the framework of the statutory retention obligations. The essential details of your order will be sent to you by email after completion of the ordering process.
The current version of these General Terms and Conditions can be accessed, saved and printed via our website. The version that was included at the time of the order applies to your order.
§ 4 Prices and Payment Terms
All prices stated in the online shop are total prices in Euro and include the statutory sales tax.
In addition, shipping costs may apply. The amount of the shipping costs will be displayed in the checkout before you place your order. Further information can be found in our shipping terms.
The available payment methods will be displayed to you during the ordering process. There is no entitlement to the provision of a specific payment method.
Unless otherwise stated for a payment method, the purchase price is due upon conclusion of the purchase contract.
When using an external payment service provider, their terms and conditions may also apply. Your legal rights against us remain unaffected.
For vouchers, discount codes and limited-time promotions, the conditions specified in the respective promotion also apply. Subsequent crediting of a discount code to an already completed order is not possible.
§ 5 Shipping and Delivery
Delivery takes place to the countries and regions that can be selected as the delivery country during the ordering process.
Storage, picking, packaging and operational shipping are carried out by our fulfillment partner HIVE. Mittelweser Heilquellen GmbH remains exclusively the contractual partner and seller.
Within Germany, standard shipping is free for orders over €25. The applicable shipping costs and shipping conditions will be displayed in the checkout before you complete the order.
The estimated delivery time can be found on the respective product page or during the ordering process. Statutory delivery periods and your statutory rights in the event of a delayed delivery remain unaffected.
We are entitled to make partial deliveries, provided that these are reasonable for you. You will not incur any additional shipping costs due to a partial delivery initiated by us.
For consumers, the risk of accidental loss or accidental deterioration of the goods generally passes to you or a recipient designated by you upon delivery of the goods.
Please ensure that the specified delivery address is complete and correct. If a shipment cannot be delivered for a reason attributable to you, the actual costs of a new shipment may be charged to you. Your legal rights remain unaffected.
§ 6 Retention of Title
The delivered goods remain the property of Mittelweser Heilquellen GmbH until full payment of the purchase price.
§ 7 Statutory Right of Withdrawal
Consumers are entitled to the statutory right of withdrawal in accordance with our separate withdrawal policy.
All information on the withdrawal period, the exercise of the right of withdrawal, the consequences of withdrawal and the sample withdrawal form can be found on our page "Right of Withdrawal".
You bear the direct costs of returning the goods, unless otherwise specified in our withdrawal policy.
Please note that the address for returning the goods may differ from our business address. Therefore, please contact us before returning the goods at kundenservice@thesourcelab.de or note the return address provided to you.
§ 8 Voluntary 30-Day Satisfaction Guarantee
In addition to the statutory right of withdrawal, we grant a voluntary 30-day satisfaction guarantee in accordance with the guarantee conditions published on our page "Right of Withdrawal".
The voluntary satisfaction guarantee applies exclusively to products purchased directly via our online shop at the-source-lab.com.
It does not apply to products purchased through other sellers, platforms or distribution partners. This includes, in particular, purchases via Amazon, Shop Apotheke, pharmacies, retailers or other online shops.
You bear the direct costs of returning the goods within the framework of the voluntary satisfaction guarantee.
Your statutory right of withdrawal and your statutory rights in the event of defective goods are not restricted by the voluntary satisfaction guarantee.
§ 9 Rights in Case of Defects and Complaints
The statutory rights in case of defects apply to all goods purchased through our online shop.
If a delivered product is defective, damaged or does not correspond to your order, you can in particular demand subsequent performance in accordance with the statutory provisions.

If possible, please provide us with your order number and the affected product. Photos can facilitate processing, but are not a prerequisite for asserting your statutory rights.
We bear the necessary costs of justified subsequent performance, in particular necessary transport and return costs, in accordance with the statutory provisions.
§ 10 Liability
We are liable without limitation:
- for intent and gross negligence,
- for damages resulting from injury to life, body or health,
- according to the provisions of the Product Liability Act,
- for fraudulent concealment of a defect,
- for the assumption of an express guarantee, as far as nothing else results from the guarantee.
In the event of a slightly negligent breach of an essential contractual obligation, we are only liable for the foreseeable, typical damage. Essential contractual obligations are obligations whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance you can regularly rely.
In all other respects, liability for damages caused by slight negligence is excluded.
The above liability regulations apply accordingly to our legal representatives, employees and vicarious agents.
§ 11 Consumer Dispute Resolution
We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

§ 12 Applicable Law and Final Provisions
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
This choice of law does not result in you being deprived of the protection of mandatory statutory provisions of the state in which you have your habitual residence.
For consumers, the statutory provisions on jurisdiction apply.
Should an individual provision of these General Terms and Conditions be or become wholly or partially ineffective, the remaining provisions shall remain unaffected. In place of the ineffective provision, the statutory provisions shall apply.
